Acceptance of these terms
By creating an account, using our website, mobile app, or GPS tracking service, or purchasing a tracker from swifttrack GPS, you agree to these Terms of Service. If you do not agree, please do not use the service. These terms apply alongside our Privacy & Cookie Policy, which explains how we handle your data. When you tap "I agree" in our app or web portal, your acceptance — and the date and time — is recorded against your account.
The service we provide
swifttrack GPS supplies a hidden GPS vehicle tracker (hardware) together with a subscription-based tracking service delivered through our mobile app and web portal. Once your tracker is installed and your subscription is active, you can view your vehicle's live location, receive movement and theft alerts, draw geofenced safe zones, and review trip history, subject to network coverage and the features included in your plan.
Your account
You must provide accurate registration details, including a valid Kenyan phone number, and keep your password confidential. You are responsible for all activity under your account. Tell us immediately if you suspect unauthorized access. We may suspend an account that provides false information or is used to violate these terms.
Subscriptions, billing & M-Pesa payments
Tracking is provided on a subscription basis — weekly, monthly, or another duration shown at checkout — paid via M-Pesa.
- A subscription is active only for the period you have paid for. It does not renew automatically, and there is no continuous billing without your action.
- If a subscription lapses, your tracker may enter a short grace period before tracking pauses. You can reactivate at any time by making a new payment.
- The amount charged is shown before you confirm the M-Pesa prompt, and a successful payment is confirmed by Safaricom's Daraja platform.
- Because payments are processed by a mobile money provider, they are generally not reversible from our side. Contact us if a payment did not reflect correctly and we will investigate.
Referral rewards & discount codes
Referral rewards and discount codes are a goodwill benefit, not a substitute for payment or a cash-equivalent asset. A code has no value once it expires, is used, or your account is closed, and it cannot be transferred, sold, or exchanged for cash. We may change referral reward terms (for example, the percentage offered) for future referrals at any time — a code already issued to you keeps the terms it was issued with.
Acceptable use
You may only install and use a tracker on a vehicle you own or have clear authority to track — for example a company vehicle, or with the owner's informed consent. Using our hardware or service to track a vehicle, or a person, without lawful authority or consent is a breach of these terms and may also be a criminal offence under Kenyan law. You agree not to tamper with, reverse-engineer, or resell tracker hardware, or attempt to disrupt the service for other users.
Device purchases, ownership & your responsibility
Purchasing a GPS tracker from swifttrack GPS is a standard retail sale — the same as buying any other electronic device from any shop or online retailer. Once you have paid for and received your tracker, you own it, and you are responsible for it: how, where, and on what vehicle it is installed and used is entirely up to you. You are also responsible for the SIM card the tracker uses — you provide your own SIM card and airtime/data bundle from your chosen mobile network operator, and you control that SIM and its number at all times. swifttrack GPS does not own, control, or have access to your SIM card, and is not responsible for charges, suspension, or loss of service arising from your SIM or network subscription.
Hardware, liability & service availability
swifttrack GPS is a technology and hardware provider, not a law enforcement agency, security company, or insurer. Tracker location and alerts depend on GSM network coverage, GPS signal, and battery charge, and can be delayed or briefly unavailable — we do not guarantee uninterrupted, error-free tracking. While the service is built to help you locate a vehicle, we do not investigate crimes, recover vehicles, or apprehend suspects — that is the role of the Kenya Police Service and other lawful authorities, and we encourage you to report any theft to them immediately and share your tracker's last known location from the app. To the extent permitted by Kenyan law, swifttrack GPS is not liable for losses, damages, or costs arising from vehicle theft, unauthorized use of your vehicle, a service outage, or a delay in alerts.
Termination
You can stop using the service at any time by not renewing your subscription, or by contacting us to close your account. We may suspend or terminate an account that breaches these terms, including non-payment, fraud, or unlawful use of the tracking service. Ending a subscription does not entitle you to a refund for the period already paid for.
Changes to these terms
We may update these terms from time to time, for example as we add new features or as regulations change. We will post the updated terms on this page with a new "last updated" date; continuing to use the service after changes take effect means you accept the revised terms.
Governing law
These terms are governed by the laws of Kenya. Any dispute arising from these terms or your use of the service is subject to the exclusive jurisdiction of the courts of Kenya.
